“Customer” means the person who books and pays for a service and is identified as the person responsible for the enrolling Participant(s);

“Participant” means a person attending an Event and may include a Customer;

“Services” means all of the free material found on the website (articles, video content and audio recordings), the private online sleep consultations offered, the online group course offered (including all associated materials), and the online support groups offered;

“Website”: the website at www.londonsleepcoach.co.uk

In these terms and conditions, “we”, “our”, or “us” refer to London Sleep Coach.

Introduction

These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and London Sleep Coach, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by London Sleep Coach and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to London Sleep Coach and accessing the Website in connection with the provision of such services.

You must be at least 21 years of age to use this Website and engage our services. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 21 years of age.

Please note that London Sleep Coach is operated by Edward Gorst, a self-employed sleep coach, and is not a licensed practitioner, psychologist, or medical professional. The services provided are intended for educational and coaching purposes only and do not constitute professional medical or psychological advice.

Intellectual property and acceptable use

All Content included on the Website, unless uploaded by Users, is the property of London Sleep Coach, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission.

You may, for your own personal, non-commercial use only, do the following: retrieve, display and view the Content on a computer screen.

Whilst London Sleep Coach uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guarantee in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

London Sleep Coach accepts no liability for any disruption or non-availability of the Website.

London Sleep Coach reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.

Limitation of liability

Our services are not intended to provide a therapeutic environment or be a substitute for counselling, psychotherapy, or ongoing medical advice from a qualified medical practitioner and subject to the below, London Sleep Coach excludes any liability relating to any statement or representation made in respect of the therapeutic, psychological or medical benefits of our services. Any unresolved issues which may surface and which may warrant medical treatment, counselling or psychotherapy, will be at the Participant’s own risk and expense.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Website or any content on it, whether expressed or implied.

If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms and Conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the Agreement.

We do not in any way exclude or limit our liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation;

Participants attend and participate in our services at their own risk. We accept no responsibility for any of the following:

  • Costs or expenses whatsoever or howsoever arising out of or in connection with any Event;

  • Loss or damage to personal property;

  • Personal injury, except as set out above. Liability is specifically excluded in respect of any dietary, health or other special requirement of which we were not informed at the time of booking; and

  • Loss of data, profit, revenue, use, business, anticipated savings, goodwill, reputation or opportunity, financial or economic loss or any indirect or consequential loss or damage.

Subject to applicable law, nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation. To the extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, revenue, or data arising from your use of our services.

General

You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

These terms and conditions together with the Privacy Policy and Cookies Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

We do not provide medical advice

The content of this Website and any service offered on this website is provided for informational and educational purposes only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition. It should never replace any advice given to you by your physician or any other licensed healthcare provider. London Sleep Coach offers sleep coaching services only and does not provide counselling, medical advice, or medical treatment. Edward Gorst is not a licensed practitioner, physician, or medical professional, and offers no medical diagnoses, treatments, suggestions or counselling.

London Sleep Coach is not a replacement for other medical or mental health care and should not be solely or primarily relied upon to treat psychiatric conditions. Do not disregard professional medical advice or delay seeking care because of information you encounter within London Sleep Coach or from our services. We do not advise making any changes to your current treatment (e.g., changes to therapy or medication) before or while using services provided by London Sleep Coach without the consultation of your doctor. If you are currently taking sleep medication, there is no need to make any changes prior to using our services. If you are interested in decreasing or stopping sleep medication use, speak to your doctor about a medication tapering plan. Always seek advice from your doctor before making any changes to your current treatments. We strongly recommend that you consult a doctor if at any time you are concerned about your physical or mental health.

London Sleep Coach is not intended to provide crisis support. If you are experiencing a crisis or medical emergency, including suicidal thoughts: In the United Kingdom, call NHS 111, call your GP, or go to your nearest A&E department. For other regions, please contact your local emergency services, or go to your nearest hospital emergency room.

Insomnia symptoms are very common across a range of medical and mental health conditions including cancer, pain, depression and endocrine or hormonal changes (for example, menopause). There is good evidence that the approaches used in Acceptance & Commitment Therapy can improve sleep even in the context of medical or mental health conditions. However, it is recommended that you consult with a doctor before using London Sleep Coach services if you have an existing medical or mental health condition, or are pregnant or recently have been pregnant.

You should not consider using any services or information or guidance from London Sleep Coach if any of the following apply to you: have bipolar disorder, schizophrenia or psychosis; have untreated and unstable mental and physical health issues; plan to change your existing prescribed medication without consulting a medical professional; can’t read or understand English; have any hearing or visual impairments; you’re experiencing a medical emergency including suicidal thoughts.

Sleep Coaching Agreement

If you use any of our services you agree to the following terms:

  • You understand that coaching is a broadly inclusive process that may include different areas of your life including and not limited to health, professional or family relationships and work. You acknowledge that it is your decision, choice, and responsibility to determine how to utilise the information we provide.

  • You understand and agree that you are responsible for your physical, mental and emotional well-being. Any choices you make or injuries that you incur from the information we provide are fully your responsibility.

  • Confidentiality: You agree that you consent to use emails to sometimes transmit sensitive information. You acknowledge the risks involved and waive any rights against us for errors made in these transmissions.

  • Definition of sleep coaching: You understand that sleep coaching is intended for individuals who want to take action and make behaviour changes in the service of their goals for life, health, well-being or work. Sleep Coaching does not involve the diagnosis or treatment of physical or mental disorders and you will not use it in place of any other diagnosis, therapy or treatment for other advice given you by medical or other qualified professionals. It is clear that sleep coaching may not be appropriate for all people.

  • We only offer services for those over 21 years of age. Children and individuals under the age of 21 should not seek advice from us and should seek professional advice.

  • You understand that our services are not intended to help anyone suffering or diagnosed with the following medical conditions: Narcolepsy, Parasomnias, Restless Legs Syndrome, Obstructive Sleep Apnoea, REM sleep behaviour disorder, Periodic Limb Movement Disorder or any other related medical conditions that can affect sleep.

Terms and Conditions for Bookings

 

Agreement

Making a booking on the London Sleep Coach for any of our paid for services involves creating a legally binding contract (the “Agreement”) between the Customer and London Sleep Coach.

We provide our services to you subject to this Agreement, so as always with a binding contract, you should read through it carefully before making a booking. We may make changes to the terms and conditions of this Agreement, but the latest version will always appear on this page. If you continue to use the services after changes have been made, you will be considered to have accepted the changes to the Agreement between us.

Bookings

The Customer is deemed to accept these terms upon booking any of our paid for services and is responsible for ensuring the accuracy of all details submitted on the booking form. These terms govern the booking for these services to the exclusion of any terms and conditions of the Customer. The booking form incorporates these terms and constitutes a legally binding contract.

When you book a service with London Sleep Coach through our website, the booking won’t be confirmed until we send you an email confirmation, even if you‘ve transferred money to us.

We will email your booking confirmation, to the email address provided during checkout. If you have not received your confirmation within 48 hours of booking, please contact us. It is your responsibility to ensure that your email is set up to allow you to receive your confirmation, and we cannot accept any liability for any consequences of your not doing so. Please retain proof of your registration, as this and/or identification may be requested upon check-in for a service.

Each Online Group Course has a specific maximum capacity for the number of people that can attend. The maximum number of people is 5.

Each Online Support Group has a specific maximum capacity for the number of people that can attend. The maximum number of people is 6.

The Online Group Course may require the submission of a participant questionnaire after a booking is made. This will allow London Sleep Coach to be made aware of any issues that need to be handled sensitively during the course and to schedule a follow up call, if necessary. If for any reason, any information provided suggests that a customer is not fit to attend the course, we reserve the right to cancel their booking and refund that Participant’s booking fees in full to the Customer.

By registering for any of the paid for services, all Participants assume the responsibility of ensuring they are physically and psychologically fit to participate in this service and that they have consulted with their doctor or psychologists as necessary. London Sleep Coach will not be making any judgement as to a Participant’s fitness to participate in a service. However, the Participant should inform London Sleep Coach (privately) of any personal concerns that may arise as the course or consultations progresses. If for any reason London Sleep Coach finds it necessary to ask a Participant to leave an online consultation, an online group support meeting or a session in the Online Group Course or the course altogether, the Participant agrees to do so immediately.

Some of the activities undertaken in the paid for services involve movement. It is always the responsibility of each participant to make the decision about whether to take part in a specific activity. If there is any doubt, the decision should always be to exercise caution and we recommend that participants consult a GP or other health professional, if ever unsure whether any activity is safe for them to do.

For the paid for services you must complete the Booking form as provided by Calendly; (i) you must ensure that the details provided by you on registration or at any time are correct and complete (ii) you must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively. (iii) you will then be prompted to pay (all payments are processed by Stripe); (iv) once payment has been authorised, you will receive a booking confirmation email (at which point your order will become a binding contract). We will not file a copy of these terms of sale specifically in relation to your order. We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of these terms of sale for your records. The only language in which we provide these terms of sale is English.

Attendance and Conduct

For the paid for services please ensure you arrive on time for each session. We welcome early arrival, but ask that you arrive no more than 5 minutes early for the consultations or group sessions.

Late arrivals beyond ten minutes to the zoom meetings for the Online Support Groups will not be permitted entry.

London Sleep Coach reserves the right to refuse admission to any person whom it considers in its absolute discretion to be unsuitable for admission to the Online Group Course or Online Support Groups or to remove any such person after the commencement of the Online Group Course or Online Group Support Session.

Confidentiality

We take the confidentiality of those who come to our Online Group Course or Online Group Support Sessions very seriously. London Sleep Coach is under an obligation to keep any Participant information shared prior to and during the events completely confidential (except as otherwise required by law).

From time to time, Participants may share sensitive personal information during a group session. We expect all Participants to respect each other’s confidentiality and treat any information shared in the course group as confidential. If it should come to our attention that information gained in this way about another Participant has been shared inappropriately or outside the group, this would be treated extremely seriously and may result in the Participant involved being asked to leave the Online Group Course and/or not attend future Online Group Support meetings.

Materials and Handouts

Unless stated otherwise, the first copy of the Online Group Course materials are included in the course fees. If for any reason additional copies are requested, these will be made available, but an additional cost may be required.

Any recorded or written material included or presented as part of the Online Group Course is protected by intellectual property laws, including copyright laws and may not be used without obtaining prior written permission from London Sleep Coach and the respective authors.

 

Cancellations or Changes to Bookings

 

Cancellation by London Sleep Coach

In the case that the course or a consultation is cancelled prior to commencement by London Sleep Coach, any advance paid fees will be refunded in full. However, we will not be able to compensate you for any other expenses you have incurred in connection with the Online Group Course or a consultation.

Session Rescheduling by London Sleep Coach

If an Online Group Course session needs to be cancelled as a result of the sleep coach absence or due to other unforeseeable circumstance, we will make all efforts to make up this session by adding a session at the end of the course at the same time and day, or by adding course time to previously scheduled class sessions. If that is not possible, it may be necessary to reschedule it for an alternative day and time. In this case, Participants will be responsible for any special arrangements required to attend the session.

If an Online Support Group session needs to be cancelled as a result of the sleep coach absence or due to other unforeseeable circumstances, Participants will be able to join a future Online Support Group session free of charge. In this case, Participants will be responsible for any special arrangements required to attend the session. If that is not possible, the Participant will be entitled to a full refund for the cancelled session.

If an Online Consultation needs to be cancelled as a result of the sleep coach absence or due to other unforeseeable circumstances, The Customer and Participant will be able to reschedule a future Consultation free of charge. If that is not possible, the Participant will be entitled to a full refund for the cancelled Consultation.

 Cancellation by the Participant or Customer

If an Agreement is cancelled by a Participant or a Customer we are unable to offer any refunds if cancelled less than 1 day prior to the first session of any paid for service. If a Participant fails to attend the Online Group Course, the Customer is not entitled to a refund or transfer.

If an Agreement is cancelled by the Customer or a Participant more than 1 day before the first session of a paid for service, we will refund the full fee. Alternatively, the full fee can be applied as a credit towards a future course, consultation or session, which must be booked in advance and is subject to availability.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the service.
